Ty for the well wishes guys, but fact of the matter is my shoulder will likely not get any better.. The rest of me will be fine tho.

It's been vacillating between no pain and feeling like I was hit by a paintball gun. I was thinking about it, tbh..

Can't believe I found this on Jalopnik of all places. Sorry to hear about this, and I really hope your shoulder heals up. So if Jace is not totaled....Custom paint? If he is....Hemi swap? lol!

Lol.. Thought about the paint, but it's only the rear that's damaged.

Got a call this afternoon, and we are going to go through our insurance. Their 50k limit has been reached for the claim. They're going to pay off our deductible, and rental until further notice.
 
Well the caddy alone would meet the 50K limit :( so everybody that's outside of the limit is SOL? or does it fall to you under-insured coverage?
 
50k limit? Who only carries 50k of insurance anymore. That just sets you up for a lwasuit that can take everything (home, car, etc) if you are at fault with major injuries and get sued.

Suz, get well soon, but keep really good records of everything and every appointment. Best of luck on the car, whatever way you choose to go.

Unfortunately you would hope this would be the case but they are protected by their insurance. Thats why you pay insurance. You can't sue the party involved you have to take the insurance company to court and fight for more money which is hard to do. In most states its common to have a minimum insurance of 50k per accident and 25k per person.

Its not right i will agree and around here This was all voted on years ago just so people could pay lower insurance premiums. But when your on the end of really needing insurance to help you you get nothing.
I know this because I have been on the end of fighting an insurance company and trying to sue the individual. Because of a really bad accident.

Hope they get it fixed if possible, I know what its like to loose a car you become attached to. I hit a F-150 at 30-35 mph ( My Eclipse into his side ). My car went under the side up to almost 3 feet, before the crumpling hood stopped me. Because of the eclipse being an A-Frame car, it ripped the front body ( driver side finder ) off the frame.. ended up being around 11k damage and car was only valued at 11-12k, so they totaled it, witch is why I am now in a Dart. But the Insurance company ( Progressive ) said it was fixable, but I sent her to the dealer in Jax FL, and they said it was done.
 
Yeah, in liability states its usually stated each person/all people involved/property. This means any single person can receive up to the first amount, the total amount paid for all people won't exceed the middle number, and any property damage to the other persons vehicle, the road, the guardrails, etc you plowed through is covered up to that limit. Anything over those amounts and they can come after you personally for the rest.

Now that I am in a no-fault state, each person involved in the accident takes care of their own stuff (and pays more for the privilege). But hey, no lawsuits (usually)!
@suzq044 I would verify that going through your insurance means they will be recovering their monetary loss from the person at fault and NOT from you via raised premiums.
