on further inspection it doesn't look like it has a "leak" but rather the cap that goes on top of the reservoir has two holes above a gasket in the cap. it appears the fluid is overflowing from the little hole seen in the first photo, past a gasket the spans the cap but is below the holes and then out the cap. this cant be normal can it? any help appreciated

Might be the hydraulic pump motor. Lift the front end on jackstands and remove the belly pan. Run the engine in drive and use a length of hose to your ear and listen for where on the trans the noise is coming from.

ill have to get to that when the snows gone around here. would you have any idea on why the trans hydraulic reservoir is overflowing? my level is below the min. could have been like that awhile, would that present any issues?

Filter might be clogged. Running with low fluid may have worn the pump. You can try disconnecting the electrical connector for a moment while it's running to see if the noise stops. You will get a code which you can clear.

Does the electrical connector i need to disconnect go into the pump #5 on your photo you posted? or where is it located? and is filter able to be checked for clogging? noise is usually only audible during a cold start up, it happened last winter and went away and came back this winter which seems like the cold effects it or makes it loud enough to hear. it goes away not long after driving or atleast i cant really hear it anymore.

The pump motor is electric so #5 in the diagram. Cold makes oil like molasses so it's possible that's the noise but you also have a pump that is pushing fluid out the cap. You should be able to look at the filter to see if it's clogged. I don't have a DDCT so i'm mostly speculating. Consider replacing the hydraulic fluid with new fluid.

do you know the part number for the reservoir hydraulic fluid? dodge tried selling me the exact fluid that goes into the trans axle and was claiming it was the right fluid but im pretty confident it was the wrong fluid.
